Terraform Labs co-founder Do Kwon’s case in Montenegro would be sent back to the first-instance court for retrial and decision after the court accepted his appeal and revoked the extradition orders.

Months after Do Kwon’s arrest in Podgorica, the capital city of Montenegro, the community has been anticipating strict actions against the Terraform Labs co-founder. However, the revoke of his extradition has frustrated some community members.

LUNC Pumps 17% After Court’s Latest Decision on Do Kwon’s Extradition

According to Montenegro’s Court of Appeal’s notice, it has accepted Do Kwon’s appeal against his extradition decision. On December 6, BeInCrypto reported that Do Kwon appealed the court’s decision, saying that he did not accept it.

Do Kwon’s four-month sentence for the passport forgery ended on December 15. After he was caught in Podgorica, both the United States (US) and South Korea requested his custody.

However, the investigation judge only informed Do Kwon regarding South Korea’s request. Meanwhile, Kwon’s opinions were not heard in relation to the US’s extradition request. As per Montenegro’s laws, this is a significant violation of the criminal procedure. The notice mentions:

Hence the High Court acted contrary to Article 16 paragraph 8 of the Law on International Legal Assistance in Criminal Matters, which stipulates that the investigating judge will inform the person whose extradition is requested, upon establishing his identity, without delay, for what reason and on the basis of which evidence it is requested his extradition and invite him to present his defense.

As the reports about the Court canceling Do Kwon’s extradition started circulating, some community members alleged corruption. Last week, the court extended a two-month jail term for the Terraform Labs’ formal boss due to the extradition appeal.

After the news broke out, the price of Terra Luna Classic (LUNC) surged by a whopping 17%.
